Apple iPhone Users Win Class Certification for Biometric Suit
Apple Inc. has lost its attempt to prevent class certification for consumers alleging the company unlawfully collected their biometric information through a facial-recognition feature in its iPhone Photos app. A US District Court judge certified three classes of iPhone users, ruling that plaintiffs met the requirements for certification of their claims under the Illinois Biometric Information Privacy Act. The lawsuit centers on allegations that the app uses proprietary software for facial recognition without user consent.
